Accommodation Contracts

Article 1 Scope of Application
1. Accommodation contracts and related agreements to be entered into between this hotel and the person to be accommodated shall be subject to the terms and conditions. Any particulars not provided for herein shall be governed by laws, regulations and/or generally accepted practices.

2. In the case when the hotel has entered into a special contract with the person insofar as such special contract does not violate laws, regulations and/or generally accepted practices, notwithstanding the preceding paragraph, the special contract shall take precedence over the provisions of these terms and conditions.
Article 2 Application for Accommodation Contracts
1. A person who intends to make an application for an accommodation contract with the hotel shall notify the hotel of the following particulars;
(1) Name of the Guest(s);
(2) Date of the accommodation and estimated time of arrival.
(3) Accommodation Charges (based, in principle, on the Basic Accommodation Charges Listed in figure No.1); and
(4) Other particulars deemed necessary by the hotel.

2. In the case when the guest requests, during his/her stay, extension of the accommodation beyond the date in subparagraph (2) of the preceding Paragraph, it shall be regarded as an application for a new accommodation contract at the time such request is made.
Article 3 Conclusions of Accommodation Contracts, etc.
1. Accommodation contract shall be deemed to have been concluded when the hotel has duly accepted the application as stipulated in the preceding Article. However, the same shall note apply when it has been proved that the hotel has not accepted the application.

2. When accommodation contract has been concluded in accordance with the provisions of the preceding paragraph, the guest is requested to pay an accommodation deposit fixed by the hotel within the limits of the Basic Accommodation Charges covering the guest's entire period of stay (3days when the period of stay exceeds 3 days) by the date specified by the hotel.

3. The deposit shall be first used for the Total Accommodation Charges to be paid by the guest, then secondly for cancellation charges under Article 6, and thirdly for reparations under Article 17 as applicable. The remainder, if any, shall be refunded at the time of the payment of Accommodation Charges as stated in Article 12.

4. When a person has failed to pay the deposit by the date as stipulated in Paragraph 2, the hotel shall treat the accommodation contract as invalid. However, the same shall apply only in the case where a person is thus informed by the hotel when the date of payment of the deposit is due.
Article 4 Special Contracts Requiring No Accommodation Deposit
1. Notwithstanding the provisions of paragraph 2 of the preceding Article, the hotel may enter into a special contract requiring no accommodation deposit after the contract has been concluded as stipulated in the same Paragraph.

2. In the case when the hotel has note requested the payment of the deposit as stipulated in Paragraph 2 of the preceding Article and/or has not specified the date for payment of the deposit at the time of the Accommodation Contract Application is accepted, it shall be deemed that the hotel has accepted a special contract prescribed in the preceding Paragraph.
Article 5 Refusal of Accommodation Contracts
The hotel may not accept the conclusion of an Accommodation Contract under any of the following cases;
(1) When the application for accommodation does not conform with the provisions of the terms and Conditions;
(2) When the hotel is fully booked and no room is available;
(3) When the guest seeking accommodation is deemed liable to conduct himself in a manner that will contravene the laws or acts against the public order and good morals throughout his/her stay in this hotel;
(4) When a person seeking accommodation can be clearly detected as carrying an infectious disease;
(5) When a person requests the hotel to bear an unreasonable burden with regards to the accommodation;
(6) When the hotel is unable to provide accommodation;
(7) When it is feared that the person desiring the accommodation, may potentially cause trouble and/or disturb other guests of this hotel. (When a person requesting accommodations is in violation of Article 5 of the Okinawa Prefectural Ordinance for Enforcement of Hotel Business Act.)
(8) When a person is found to be a member of the organized crime in relation to Article 2 and the 6th gang, member in "Law concerning the prevention of an unjustified act by the gangster etc. (Article 77 of the law in 1991)" or the gang member in Article 2 paragraph 2 of this law.
Article 6 Right to cancel Accommodation Contracts by the Guest
1. The guest is entitled to cancel the Accommodation Contract by so notifying the hotel.

2. In the case when the guest has cancelled the Accommodation Contract in whole or in part due to causes for which the guest is liable (except in the case when the hotel has requested the payment of the deposit during a specified period as prescribed in Paragraph 2 of Article 3 and the guest has cancelled before the payment), the guest shall pay cancellation charges as listed in figure NO.2. However, in the case when a special contract as prescribed in Paragraph 1 of Article 4 has been concluded, the same shall apply only when the guest is informed of the obligation of the payment of the cancellation charges in case of cancellation by the guest.

3. In the case when the guest does not appear by 8:00 p.m. of the accommodation date without any advance notice or within 2 hours after the expected time of arrival (that is, of the hotel has been advised of the guests arrival time), the hotel may regard the Accommodation Contract as being cancelled by the guest.
Article 7 Right to cancel Accommodation Contracts by the hotel
1. The hotel may cancel the Accommodation Contracts under any of the following case;
(1) When the guest is deemed liable to conduct and/or have conducted himself in a manner that will contravene the laws or act against the public order and good morals in regards to his accommodation;
(2) When the guest can be clearly detected as carrying an infectious disease;
(3) When a person requests the hotel to bear an unreasonable burden with regards to the accommodation;
(4) When the hotel is unable to provide accommodation due to natural calamities, damage to its facilities and/or other unavoidable causes;
(5) When it is feared that the person desiring the accommodation, may potentially cause trouble and/or disturb other guests of this hotel. (When a person requesting accommodations is in violation of Article 5 of the Okinawa Prefectural Ordinance for Enforcement of Hotel Business Act.)
(6) When a person is found to be a member of the organized crime in relation to Article 2 and the 6th gang, member in "Law concerning the prevention of an unjustified act by the gangster etc. (Article 77 of the law in 1991)" or the gang member in Article 2 paragraph 2 of this law.
(7) When the guest takes actions which are prohibited such as smorking in bed, interfering with fire-fighting facilities and other provisions of the House Regulations stipulated by the hotel.
(8) When the guest fails to observe the House Regulations as stipulated by the hotel.

2. In the case when the hotel has cancelled the Accommodation Contract in accordance with the preceding Paragraph, the hotel shall note charge the guest for any accommodation services not yet provided.
Article 8 Registration
1. The guest shall register the following particulars at the reception counter of the hotel on the day of arrival:
(1) Name, age, sex, address and occupation of the Guest(s);
(2) Nationality, passport number, port and date of entry to Japan for guests from overseas;
(3) Date and estimated time of departure; and
(4) Other particulars deemed necessary by the hotel.

2. Accommodation Charge described in Article 12 by any means other than Japanese Currency, such as traveler's cheques, coupons or credit cards, these credentials shall be shown in advance at the time of the registration as stated in the preceding Paragraph.
Article 9 Check-out Time
1. Guests of the hotel are asked to vacate their rooms by 11a.m. (check-out time)

2. The hotel may, notwithstanding the provisions described in the preceding Paragraph, permit the guest to occupy the room beyond the checkout time. In this case, extra fees shall be charged as follows:
(1) Up until 3:00p.m. : 50% of the rack rate of the room the guest is occupying
(2) Up until 6:00p.m. : 66% of the rack rate of the room the guest is occupying
(3) After 6:00p.m. : Full rack rate of the room the guest is occupying
Article 10 Scope of Application
1. The guest shall observe the House Regulations and other Provisions established by the hotel, which are posted within the premises of the hotel.
Article 11 Business Hours
1. The business hours of the hotel shall be as follows:
(1) Dining
 1. Breakfast 7a.m. to 10a.m.
 2. Lunch 11:30a.m. to 2.30p.m.
 3. Dinner 6p.m. to 9:30p.m.
(2) Beach 9a.m. to 5p.m.
Article 12 Payment of Accommodation Charges
1. The breakdown of the Accommodation Charges, etc. that the guest shall pay is listed in Figure 1.

2. Accommodation charges, etc. as stated in the preceding Paragraph shall be paid with Japanese currency or by any means other than Japanese currency such as traveler's cheques, coupons or credit cards, that are recognized by the hotel at the reception counter at the time of departure of the guest or upon request by the hotel.

3. Accommodation Charges shall be paid even when the guest voluntarily chooses not to use the facility.
Article 13 Obligations of the hotel
1. The hotel shall compensate the guest in the fulfillment or nonfulfillment of the Accommodation Contract and/or related agreements. However, the same shall not apply in the case when such damage has been due to reasons for which the hotel is not liable.

2. The hotel is covered by Liability Insurance in order to deal with unexpected fire and/or other natural calamities.
Article 14 Handlin when Unable to Provide Contracted Rooms
1. The hotel shall, when unable to provide contracted rooms, arrange accommodation of the same standard elsewhere for the guest with the consent of the guest.

2. When arrangement of other accommodation cannot be made notwithstanding the provisions of the preceding Paragraph, the hotel shall pay the guest a compensation fee equivalent to the cancellation charges to be cannot provide accommodation due to causes for which the hotel is note liable, the hotel shall not compensate the guest.
Article 15 Handling of Deposited Article
1. The hotel shall compensate the guest within the limit of 150,000 yen for damages when loss, breakage or other damage is caused to items, cash and/or valuables deposited at the reception counter, except in the case when this has occurred due to force majeure.

2. The hotel shall compensate the guest for damages when loss, breakage or other damage is caused by intention or through negligence on the part of the hotel, to items, cash or valuables brought into the hotel premises by the guest deposited at the Reception Counter. However, for articles of which the description and value have not been reported the guest within the limit of 50,000yen, except in the case that loss, breakage or damage has occurred by intention or through negligence on the part of the hotel.

3. The safety boxes located in the guest rooms are used in accordance to the instructions provided.
Article 16 Storage of Baggage and / or Belongings of Guest
1. When a guest’s baggage arrives at the hotel prior to his/her check-in, the hotel shall take responsibility for its storage only when a request for storage has been accepted by the hotel. The baggage shall be handed over to the guest at the reception counter when he/she checks in.

2. In the event that the guest’s baggage or belongings are left in the hotel after checkout, the hotel shall wait for contact and instructions from the owner. If there are no instructions from the owner or the owner cannot be identified, the forgotten item shall be kept in the hotel for 7 days, including the day on which it was found, pursuant to the Lost Property Act. After the 7th day, the forgotten item shall be sent to the nearest police station.
Article 17 Obligations of Guests
1. In the event that the guest causes damage to the hotel either willfully or due to negligence, the guest shall compensate the hotel for the damage.

2. In the event that the guest fails to perform the momentary obligation in accordance with the Accommodation Contracts, the hotel may claim delay damages from the guest at an annual rate of 14.6%.
Article 18 Agreed Jurisdiction, Governing Law and Language The Naha District
1. Court shall be a court with non-exclusive jurisdiction over any dispute arising from the Accommodation Contract. The Accommodation Contract shall be governed under the laws of Japan, and this Contract shall be interpreted under the laws of Japan.

2. The official version of this Contract shall be the Japanese version, and an English translation shall be produced. The English version shall be produced merely for the purpose of referencing the official Japanese version. The Japanese version shall prevail in all cases.

Notes
1. The "%" signifies the rate of cancellation fee applicable to the basic accommodation fee.
2. When the number of days contracted is shortened, cancellation fee for its first day shall be charged regardless of the number of days shortened.
3. For group bookings of 15 persons or more, cancellation charge will apply for cancellations of more than 10% of guests, made 10 days or less prior to arrival. Fractions will be counted as whole numbers.
